Plaintiff wins $3M after parking lot crash

A pedestrian who was struck by a distracted driver in a Costco parking lot in Wyoming, Michigan, has secured a $3-million verdict in Kent County Circuit Court.

In Angela Jones as Guardian of Kathryn Corinti v. Jane Secord and Todd Wenzel Chevrolet, the defense ultimately admitted negligence at the time of trial but argued the plaintiff made a significant recovery from her injuries.

“The driver admitted negligence. The auto dealership which owned the car didn’t admit negligence but they were bound by her admission of negligence. They didn’t have a choice,” said plaintiff’s attorney Geoffrey Fieger of Fieger Law in Southfield.

Case background

On July 1, 2016, the plaintiff was walking into Costco when the defendant struck her while going between 5 and 10 mph.

Witnesses saw the driver looking behind her and speaking with her grandchildren when she ran over the plaintiff.

The 67-year-old pedestrian sustained a traumatic brain injury, subdural hematoma, skull fractures and pelvic fractures. She underwent a decompressive craniectomy, duraplasty and evacuation of epidural hematoma.

“Negligence was pretty clear,” Fieger said. “Witnesses saw her turned around while running over a woman walking into the store. I don’t think negligence would have been an issue in the case.”

Recovery plateau

Fieger said the defendants argued that the pedestrian was able to make a significant recovery from her injuries and her medical treatment was almost completed.

They argued the plaintiff was very active, independent and resumed much of her pre-accident lifestyle.

The plaintiff countered that she still had significant disabilities from her brain injury, and those symptoms included physical impairments, impaired cognition, depression and anxiety. She was on longterm medications, and said the impairments negatively impacted her family life and disabled her from her pre-accident employment.

“Although all of the doctors said brain damage was permanent and after a year you plateau and reach as good of recovery as you can possibly reach, the defendants were trying to suggest she was still healing and that she was going to get all better,” Fieger said. “That’s blatantly absurd. Like her doctors testified, you don’t recover from this type of brain damage, you don’t ever fully recover.”

To prove the extent of his client’s injuries, Fieger said the use of 3-dimensional imaging of her skull fractures from CT scans seemed to influence jurors significantly.

“The 3-D imaging was an incredible tool to demonstrate to jurors the extent of damage,” Fieger said. “It vividly shows in a 3-D image where the skull was crushed. You just don’t see it on a regular CT scan, but on a 3-D one, you do.”

Fieger said two witnesses to the accident testified during the trial, and there were 14 witnesses total.

Because the injuries were related to an auto accident and medical costs were already covered, the verdict amount of $3 million in late August was mostly for pain and suffering costs.

Defense attorney Christopher Jelinek did not respond to requests for comment on this case.
